Which tier is likely to apply?
The tier usually depends on the greatest number of people, including staff, that can reasonably be expected to be present at the same time, from time to time — together with the other qualifying criteria in the Act.

The important exceptions
Qualifying places of worship and premises used for childcare, primary or secondary education, or further education remain within the Standard Tier even where 800 or more people may be present.
Capacity alone does not determine whether Martyn's Law applies. The type and use of the premises, the number of people reasonably expected to be present, exclusions and special provisions all need to be considered. For definitive information about whether your premises or event is within scope, refer to the current statutory guidance issued under the Terrorism (Protection of Premises) Act 2025.

What the assessment asks
- What kind of premises or event it is
- How it is used, and by whom
- The greatest number of people reasonably expected at once
- Whether any exclusion or special provision applies

A plain-English list of what a Responsible Person should be able to point to — whichever tier applies. Use it to work out where you already are, and what is missing.
What is on the checklist
- Who is present, when, and how you arrived at that number
- A recorded assessment of the premises and its risks
- Evacuation arrangements — routes, assembly, who decides, who checks
- Invacuation arrangements — the safer area, and how people get there
- Lockdown arrangements, where appropriate
- How you tell staff, visitors, contractors and responders what is happening
- Staff briefing — who has been told what, and when
- Named owners and target dates for everything outstanding
- Where supporting evidence is kept
- A date in the diary for the next review
