These Terms of Use (“Terms”) govern your use of the arx Partners Martyn's Law self-assessment and workbook (the “Service”), provided by [REGISTERED COMPANY NAME] (“we”, “us”, “arx Partners”), company number [COMPANY NUMBER], registered in England & Wales at [REGISTERED ADDRESS]. By creating an account or using the Service you agree to these Terms.
1. What the Service is
The Service helps those responsible for premises and events to understand and prepare for their obligations under the Terrorism (Protection of Premises) Act 2025 (“Martyn's Law”). It provides a self-assessment that gives an indicative result, and a workbook to record the information a duty holder is expected to hold.
The Service provides general information and a structured record. It is not legal advice and does not guarantee compliance with Martyn's Law or any other law. You remain responsible for meeting your own legal obligations, and should refer to the official statutory guidance and take professional advice where needed.
2. Your account
You must give accurate information when you create an account and keep it up to date. Each login is for a single named person — do not share your password or let others sign in as you. You are responsible for activity under your account and must keep your password confidential. Tell us promptly if you think your account has been used without your permission.
3. Acceptable use
You agree not to misuse the Service: no unlawful, misleading or infringing content; no attempts to gain unauthorised access, disrupt the Service, or probe its security; no automated scraping or overloading; and no uploading of malware or of anyone else's personal data without a lawful basis to do so.
4. Your content
You keep ownership of the information, documents and images you put into your workbook (“Your Content”). You grant us the licence needed to host, process and display Your Content so we can provide the Service to you. You are responsible for the accuracy of Your Content and for having the right to upload it.
5. Fees, seats and renewals
Access to the workbook is a paid subscription. Prices are [STANDARD PRICE] per year for the standard tier and [ENHANCED PRICE] per year for the enhanced tier, plus [£5] per additional user login per year. Fees are shown at checkout and, unless stated otherwise, are exclusive of VAT. Subscriptions and any [renewal/refund] terms are as described at the point of purchase.
6. Availability
We aim to keep the Service available but do not guarantee it will be uninterrupted or error-free, and we may carry out maintenance or make changes to features from time to time.
7. Intellectual property
The Service, including its software, content, design and branding (but excluding Your Content), belongs to us or our licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service for your own compliance purposes for as long as your subscription is active.
8. Disclaimers and liability
The Service is provided on an “as is” and “as available” basis. To the extent permitted by law, we exclude implied warranties. Nothing in these Terms limits liability that cannot be limited by law (such as for death or personal injury caused by negligence, or for fraud). Subject to that, our total liability arising out of or in connection with the Service is limited to [the fees you paid in the 12 months before the claim], and we are not liable for indirect or consequential loss, or for any failure to comply with Martyn's Law or other legal duties, which remain your responsibility.
9. Data protection
We process personal data in accordance with our Privacy Policy, which explains what we collect, how we use it, and your rights. By using the Service you acknowledge that Privacy Policy.
10. Changes to these Terms
We may update these Terms from time to time. When we make a material change we will publish the updated Terms and increase the version number, and you will be asked to accept the new version the next time you sign in before you can continue using your workbook. Continuing to use the Service after accepting means you agree to the updated Terms.
11. Suspension and termination
We may suspend or end your access if you breach these Terms or where we are required to by law. You may stop using the Service at any time. On termination your right to use the Service ends; provisions that by their nature should survive (such as intellectual property, disclaimers and liability) will continue.
12. Governing law
These Terms are governed by the laws of England & Wales, and the courts of England & Wales have exclusive jurisdiction, unless your local law requires otherwise.
